These Terms of Service (“Agreement”) apply to your access and use of FORM Smart Swim Goggles and related services offered by Denaster General Trading LLC (“Denaster”), the exclusive authorized distributor of FORM Athletica Inc. (“FORM”) in the United Arab Emirates (UAE). By using the FORM Services and Goggles in the UAE, you agree to comply with these terms.

 

1. Eligibility

    • You must be 18 years or older to use the services and make purchases.
    • Children under 18 must have supervision and consent from a parent or guardian.

 

 

2. Account and Software Access

 

    • To access certain features, you may need to create an account via the FORM mobile application.
    • You are responsible for maintaining the confidentiality of your account credentials.

 

3. Software License

 

    • FORM grants you a limited, non-exclusive license to use its software with the Goggles for personal, non-commercial purposes.
    • You may not reverse-engineer, modify, or distribute the software.

 

4. Acceptable Use

 

You agree not to:

    • Violate any applicable UAE laws or third-party rights.
    • Upload harmful code or interfere with the operation of the software or services.
    • Use the services to create a competing product.

 

5. Content and Data

 

    • You retain ownership of your data but grant FORM the right to use it to improve the service.
    • Denaster and FORM may collect anonymized usage data for analysis and improvement.

 

6.  Linked Services

 

    • You may choose to connect third-party fitness or tracking apps at your own discretion and risk.
    • Denaster and FORM are not liable for third-party services or their data practices.

 

7. Disclaimer

    • Services are provided “as is” without warranties of uninterrupted operation or compatibility.
    • You use the Goggles and mobile app at your own risk, particularly during physical activity.


8. Limitation of Liability

 

    • To the fullest extent permitted by UAE law, Denaster and FORM are not liable for indirect or consequential damages.
    • Total liability will not exceed the original purchase price of the product.

 

9. Termination

 

    • Denaster may suspend or terminate your access to the services if you breach this Agreement.
    • You may stop using the services at any time.

 

10. Governing Law

 

    • This Agreement is governed by the laws of the United Arab Emirates.
    • Any disputes shall be resolved in the courts of Dubai.
